Integrasi Maqāṣid al-Syarī‘ah dalam Regulasi Ekonomi Biru dan Hijau: Kajian Literatur Kekosongan Normatif

Abstract

Perkembangan ekonomi biru dan hijau di Indonesia bergerak begitu cepat hingga kerap meninggalkan kebutuhan akan pijakan etik yang lebih solid, terutama dari tradisi hukum Islam yang semestinya memberi arah moral bagi kebijakan ekologis. Ketidaksiapan perangkat normatif syariah untuk membaca isu keberlanjutan memunculkan kegelisahan akademik, sebab ruang etik yang longgar itu dapat mengaburkan tujuan perlindungan lingkungan. Tujuan penelitian ini mengkaji sejauh mana integrasi Masqashid Syariah  dalam regulasi ekonomi biru dan hijau. Kajian ini menggunakan studi literatur kritis dengan pendekatan hermeneutik untuk menautkan kembali teks Maqāṣid, regulasi ekonomi biru–hijau, dan wacana tata kelola lingkungan sebagai arena dialog nilai. Pemilihan sumber dilakukan secara selektif, terutama yang memperlihatkan gesekan antara prinsip syariah dan realitas kebijakan, sementara koherensinya diuji melalui triangulasi argumentatif. Hasil pembacaan menunjukkan bahwa arah kebijakan sering melaju lebih cepat daripada kerangka etiknya, sehingga lima ḍarūriyyāt yang beririsan dengan isu kelautan, biodiversitas, polusi, dan ketahanan pangan pesisir belum terserap dalam desain regulasi. Beberapa ranah penting seperti tata kelola karbon, jasa ekosistem, dan perlindungan komunitas adat pesisir masih berada di luar jangkauan operasional Maqāṣid. Kondisi ini membuka peluang untuk memindahkan Maqāṣid dari tataran prinsip menuju alat kerja yang lebih terukur, misalnya melalui indikator kemaslahatan ekologis dalam evaluasi dampak lingkungan. Penelitian ini menegaskan bahwa Maqāṣid dapat berperan sebagai kompas etik bagi kebijakan biru–hijau, asalkan integrasinya ditopang mekanisme regulatif yang lebih konkret demi tercapainya keberlanjutan yang bernilai dan tahan lama.
